To whoever it may concern,

The purpose of this email is to inform the recipient(s) that strict official copyright laws exist on all recordings by artists on the Warner Music International roster. This also encompasses live and unofficial recordings that may be used for the sole purpose of electronic and digital files that may be uploaded for general access by unauthorised users. The intentional flouting of such copyright laws and failure to observe these conditions may result in legal procedures applied or instigated against the holders of such IP accounts who use them to create FTP sites wherein the uninhibited exchange of illegally-obtained recordings (MP3s, Real Time Movies, Real Audio files, WAV files ) by our artists continues to take place.

We would therefore strongly advise the recipent(s) against the further practice of illegal exchanging of such files on FTP sites and to cease with immediate effect any other means of trading that has been taking place.

Can you post the full headers of your email? It's likely legit, but that may be a more definitive way to find out than a poll. :)

Wonder what (or whom, hmmm) tipped 'em off...

I must warn you I hve received a similar mail and there was a .bat file attached which would have been their scan of my illegal files but it's actually a virus of course. Don't ever, never open attachements of these mails, usually virus mails are pretty stupid (remember SnowWhite? Who was so stupid to open?) but I must admit is criminally well conceived. It exploits the panic of the recipient when they get a likely legal warning and they wanna check to see more, but it's just a virus in fact. I wouldn't believe to any mail like this, it also sounds too general, it's obvious it's a template written for any recipient, it's not written for you. Legal matters for file sharing, are really happening, but not this way. The day you'll receive a proper legal notice from the RIIAA bastards, it'll be really different.

Floyd it looks like a broadcasted scare tactic email (albeit a decently written one), no references are made to the actual name of the "artist on the Warner Music International roster" whos copyright you are apparently infringing on, the RIAA (of which Warner Music is a member) has no jurisdiction over your country and thus of course the stupid DCMA is useless against you. If this were a genuine email you would probably be contacted by a record association specific to your country. But be careful of hackers, it sounds like someone has some issues with you... hang in there :skeptic:

I might be wrong, but I would expect such an email to come from Warner's legal counsel and not from their A&R people. The language doesn't ring true either. Just my 5c worth there.

There has been a scam circulating recently along similar lines that called for a payment to be made in respect of Data Protection.

First bet is to check out the details given on this mail, does Elizabeth whatever exist ? Is there a valid phone number ?

ALso bear in mind that a prominent member of NOOL has a relative who works for Warner Bros legal dept....

Aye, if it were a formal message, they should have provided very clear contact details. Reply to the email, asking for a registered address, details of their exact role within Warner and whom they represent, specific details of what leads them to send this message to you in the first place, and most importantly a valid telephone and fax number.

Besides which, if this were genuine and they have legal clout for what you are being contacted for, why Warner? Surely either someone representing the record company of whichever country your servers are in should have contacted you - what makes Warner think their copyright has been infringed, when there are many different companies that release material by individual artists across the globe.

Sounds suspect to me.

For a start, live and unofficial recordings are not carried as part of the Warner Brothers/London Records deal with the band - the songs are owned by the publishing company/the band (who happen to be one and the same). WB only have rights on products that they have released. Assuming that they have a "normal" contract of course, as per the BPI and Musicians' Union.

Can't say I've used Floyd's server for anything other than the Lamacq and Peel sessions, but it's a tad harsh if someone has grassed him up?

I'd be surprised if anyone has grassed him up at all. It's not exactly been kept much of a secret on here though, has it, and anyone can read these messages, including the band and their representatives, who are known to visit the site.

Seb's father is head of Warner Canada isn't he ?

As for the legitimacy of this snail, if it was genuine it would be much more specific in the details of the alleged offences. It would have named the I.P. address from which you allegedly perpetrated this horrendous crime, and would have been specefic about the number of files you were sharing. Take it from me, it's a fake. Untie your panties!

take no notice floyd, like one of the other guys said it is a scam. many file sharing sites are the targets of the scamsters,i dont know why this is maybe they resent the file sharing activities or some shit like that. another thing thats scary,some of the "bigger" file sites always seem to have been ingfected by nasty viruses,makes you wonder where the viruses are coming from doesnt it? if you try downloading files from the bigger sites without an adequate firewall you are in a world of hurt! in all honesty i havent been on your site to download anything,nor have i visited your site. i know some of the noolers do visit regularly. so keep up the good work1 if you get busted by the fuzz,we'll have a whip round for you to get you out of jail,if not we'll call the A TEAM.!!!!!!!!!!!!!!! regards :nuts:

That's why lawyers charge £250 plus per hour.

The data protection scam previously mentioned is a well documented scam that operates in the uk and it asks directly for £95. It comes via the post and relies on peoples naivety regarding the UK Data Protection Act.

FLOYD...even though what you do does seem a little adverse i don't relly think anyone here in THE COMMUNITY would have tried to spoil it for you really.Surely this site has been up for too long for anyone to actually bother so late in the day.Despite my ironic comments here last night i should point out that i neither want your site CLOSED or care if anyone else here has stitched you up.It will not be the first time that when someone in THE COMMUNITY has helped others people have tried to get it stopped.For example when i said i would copy a CD..even though it is my right to do so...angry voices were heard.I ignored them because the same people equally did ILLEGAL things here and openly talked about it.So what is good for the goose is good for the gander.As for is it GENUINE or NOT i shouldn't think so.So chill out and enjoy what you do.You have indeed give a lot of other NOOL's pleasure here.I don't need to use your site but that is because i was fortunate enough to ONLY want the ORIGINAL products for the artwork.But i know some of you here cannot get hold of these tracks for whatever reason.I don't believe SHUGZV is responsible ...another joke.I will also make jokes at anything i want here as surely we have free speech. :thumb: Cheers ROCKET MICK

True, but it is coincidental that Floyd should get one after all the debate on here about the merits and suchlike of his FTP server. It could well be of course that the scammer has access to a database of FTP site holders.

Whoever sent it knows enough about New Order's record label's global operations to know that this would have an impact. Unless the mail came on authentic Warner Bros e-mail stationery (and a company as far up their own ass as Warner would definitely have their own logo on anything) and unless the mail came from a Warner account (again, easily traceable), I would suspect that it is a scam or at least something from someone in a position to do this, which narrows down the field considerably.

Shug, do you want an original vinyl copy ? Slight rip on the sleeve where it was sellotaped to the magazine, but in good nick apart from that. I'll pick it up over the weekend from home and mail it to you. Has no value to me.

Let's say if that was legit, I would have gotten one also for the real media files online here... and videos... and probably all the pictures on this website.

Although it might be a good idea to stop posting publicly about the site and do it via email or something with the users interested? Just a reminder that you have a full thread full of most people who sent stuff, hence proofs... a goldmine for lawyers..

Even though I still believe Warner don't give a **** about New Order...

Whether it's a scam or a sick joke by someone looking to (successfully) stir things here, how can we tell :shrug: I just like to stress that I do not have any objections to Floyd and his server. However, I do feel that it would be best if it was hidden so that the site doesn't run the risk of getting shut down, as was argued when the weeding was discussed. That's all I was trying to say when I added my tuppence worth earlier this week, but somehow it was all taken out of proportion. I get the feeling we're all a bit tetchy lately ...

Well, if any representatives of Warner/London do read these messages, they'll see a bloody large consensus of opinion that WE WANT THE HARD TO FIND STUFF US FANS PAY A SMALL FORTUNE ON EBAY FOR RELEASED ON CD!!! That's the main reason a few people are keen to trade/swap the stuff that is all but impossible to get hold of in this day and age. Both London and Warner are major labels, for Christsake, they can MARKET and SELL this stuff, and there must always be at least a modest demand for New Order stuff - you package it carefully enough, and pile loads of rare stuff on a few CDs, guess what - you'll make a PROFIT and reduce the number of people seeking to pirate/fileshare the old vinyl tracks!
