I hope he is convicted of 1st degree murder. 2nd degree (the evidence absolutely does not support such a charge) will lead to a quick appeal, and please I hope the jury doesn't find this man not guilty. The punishment should be left to Nancy Grace from Court TV :evil:

I think this may be the first murder conviction of an unborn child. Religious Right creaming their pants. Waiting for Liberals to say "OH SHIT!!"

Trial in California, right?? No death penalty there. This case may bring it back.

Oh, they've got the death penalty alright (I think it was in the news recently that they just executed a guy...then again, that could've been Texas )

I'm mixed on whether to give the guy death. On the one hand, it's an easy call considering the hideousness of the crime. Then again, I look at the death penalty a bit like it's not living up to its purpose of being a deterrent. What's more, in some way, by putting him to death we take away the prospect of having to face himself in prison every day, knowing what he's done. If the jagoff gets death, in a weird way it's almost like he's won. He doesn't have to spend the rest of his days living with his crime, because he won't have much longer to live anyway. That's the way I look at it, as if the death penalty is too good for him.

Any man that kills his wife an unborn baby so he can screw another bitch does not deserve to live. Now, consider that all the evidence used to convict him was circumstantial and I might have issues. But I am pretty sure california does not execute.

I think he's guilty...not sure that there was enough evidence for "premeditation"...I'd prolly go with 2 counts of 2nd degree based upon what I saw.

I don't get the 1st degree (premeditation) for the wife but 2nd for the child...I mean, you cant really believe that he thought about killing his wife beforehand and not know that the child would die as well...

Perhaps that is the reason for the foreman wanting out...he was leaning 2nd/2nd...

not only do they execute, they have more people on death row than texas! (including richard allen davis--remember him? he kidnapped that girl polly klaas from her bedroom in petaluma then killed her.) however, they haven't executed anyone since 2002.
