January starts well then...

Andy received tremendous news from pal Peter Hook today announcing that New Order WILL be playing Manchester v Cancer. He said, “It’s just fantastic news, the band had a meeting this week and decided to go for it!”

It’s a real coup for Manchester v Cancer and perfectly compliments it’s already stellar line up. Christie Hospital appeals director Toni Leden remarked “Just like the Christie itself, the band is a real Manchester institution and we're thrilled they're generous enough to donate their time to help our cause like this. I'm sure it will be a performance to remember.”

Fuck me it took me nearly a week to make contact with planet earth again after the apollo and I wasn't even shitered. Then again I suppose the NO culture shock diminishes over time, you hardnut vikings are probably toughenned up to it a little.

The Darlo order have also had a meeting today and agreed unanimously that it's a def. goer. 4 of us so far.

I would be up for that one. I'll be working in Switzerland but it would be worth coming back for a weekend, I reckon!

I'll be there, obviously, not much of a journey for me! Now I've got New Order and Belle & Sebastian in the same weekend, yet more excuses to put off taking the big flight back to the states. Not that I really need any

What would be nice is if this turns into a day long event. That way NO could do a full length set, and Doves as well. Hope they have standing tickets on offer though, hate to get stuck up in the rafters of the MEN.

Heavily suspect it'll be a half hour set job, the logistics of making it a full day are horrendous. Worth every second though, can't wait for this one.

i'll be going, lets hope its a large venue so no mad scramble for tickets!

EDIT. Just as an additional point. Does everyone think the strapline for this 'Manchester vs Cancer' is a little bit much. Doesn't sound like they had the marketing men on that one. The lad we got the dedication for at the Apollo, Phil Grubb, he passed away from cancer in May. Spoke to his brother last night saying that New Order are doing this Cancer Benefit, and he told me their Mum got taken by cancer as well, on Wednesday. There's only usually one winner when cancer's concerned, sadly, and giving it the big 'un, Manchester's taking on cancer, or whatever, doesn't wash with me. Just think they should play down the aggressive stance where cancer's concerned.

Al, believe me, I really really do know what you mean on this one; I do. Cancer is well, cancer.. sometimes there's no justice and that's life. Every victim is someones wife, daughter, mother or whatever; husband, son, father etc.... it's the shitiest of diseases because it doesn't discriminate - it just gets YOU - ME! I don't care who gets the marketing on this one - it's a real pity the fookin gnment can't put as much effort and money into cancer and see the kids' faces at their mothers graves (or fathers') - no let's just put the tax on the fags instead.....it's all a ***** joke! A very heartfelt cause, I'm sure we can all relate personal experience to this one. This will be THE gig of 2006, without doubt. The line up speaks for itself, the cause doesn't need to speak, it's just a cause that will always be supported by us all, the fact that the line up is so good just makes it that bit better. It is fantastic to see 'proper' bands doing 'real' charity stuff, in schools, for cancer...there are not many that really do it for the right reasons anymore, but those that do deserve our full support...New Order, Roger Daltrey (a total and complete star), U2, Sir Paul, Doves...to name a few. The Darlo Order will most definately be there.

FREEBASS are advertising for a lead singer with the same calibre as Ian Brown,Barney and Morrissey..only younger,with something to say.Will they have him in time for January? Or will they borrow the Doves lead singer for the day?

I've got Belle & Sebastian on the Friday, Sunday and Monday...So it's the only free day I've got. This makes me think its destiny. Given half a chance I'll be going.

Stone Roses is the next obvious speculative suggestion. They always did like a good benefit gig. Gutted if the Order have dropped out already, though it's not impossible that the organisers started announcing their appearance without the band's permission?

This is not looking good. I know Gillian is 45 the day before the gig but surely the family celebrations could include playing at this event. I have emailed the website, IF they reply with anything I will post it ASAP. BOLLOCKS my day has been ruined.

The latest statements from M Joyce on a BBC 6 radio interview as faithfully reported on the MorrisseySoLow site have been brought to my attention and I feel I should make this reply as an attempt to put the matter straight.

1. From '83 to '87 M Joyce happily and willingly received 10% of Smiths recording royalties.

2. In '89, as is documented, Joyce sued Morrissey & Marr for 25% of Smiths recording royalties.

3. In '96, Joyce took his claim to court - and on the basis of the 1890 Partnership Act the judge awarded Joyce 25%.

4. In '97, M Joyce was paid 215 thousand pounds from me, and 215 thousand pounds from Johnny Marr.

5. In '99, Joyce appeared on British television and made the statement: "There was no contract saying we were gonna get 25%."

6. In 2001, as a final payment of back royalties, Johnny Marr paid Joyce 260 thousand pounds, plus "costs." At this time I was in the US and was not served with court proceedings, so Joyce obtained a Default Judgment. He then put forward a claim from me for 688 thousand pounds - well above and beyond the amount Johnny Marr was ordered to pay. In my absence, the figure was not contested.

7. Since 2001, and because of the Default Judgment against me, Joyce has taken out Third Party Orders against the following societies: my personal bank account in England, Smiths royalties from Warner Music, my personal PRS royalties, my personal PPL royalties, and he has attempted to seize UK concert fees from venue to venue. This money, to date, totals 700 thousand pounds. This figure is in addition to the figures mentioned above.

8. By grabbing the full total of Smiths royalties from Warner Music (and this means that when the public buy a Smiths CD in the UK, the royalties go to Joyce, and have done so since 2001) Joyce has knowingly deprived Andy Rourke of his 10% Smiths royalties, and has deprived producers John Porter, Stephen Street, Grant Showbiz and Steve Lillywhite (for "Ask") of their entitlements. Joyce did not declare to the courts that others - namely, the above - were also beneficiaries to the Warner Music royalties.

9. In 2001, Joyce attempted to seize both my mother's house and my sister's house by claiming that I had taken my assets out of the UK; he made this claim even though he had direct access to all of the above – which are in the UK. Joyce eventually dropped both of these claims due to lack of evidence, and he refused to pay the 150 thousand pounds that it had cost me to defend his groundless claims. Joyce also dropped his claim as co-composer with Johnny M on Smiths compositions, and Joyce also dropped his claim for Producer royalties on Smiths recordings, and Joyce also dropped his claim for a share of Artwork payments given to me for providing Smiths record sleeves. There were, in fact, no payments to me for Smiths Artwork. Joyce made a further claim for 25% of all Smiths t-shirts sold during the '83 to '87 period, even though there was no evidence that any royalty for t-shirts had been received by either myself or Johnny Marr.

10. In legal fees alone, Joyce has cost me 600 thousand pounds - this is quite apart from any payments made to him, and is quite apart from any money seized by him. In total, Joyce has cost me 1 million, 515 thousand pounds. This is an approximate figure - it could even be higher.

11. The Joyce action is continuous. Because of his Default Judgment he continues to take my royalties, and the royalties of others mentioned above, from Warner Music - consequently I have not received record royalties since 2001.

12. Since 2001, the money claimed by Joyce is charged, to me, at 100 pounds a day in interest.

13. During the Smiths' lifetime, when Joyce willingly took a 10% royalty, he did not contribute towards any expenses of any kind, did not take on any Partnership duties or responsibilities, and he received his 10% as gross earnings.

The point I wish to make is this: Joyce is not poor, unless, living as he does in the Cheshire green-belt, he lives beyond his means. Somehow, he appears to believe that he should have equal financial status to both myself and to Johnny Marr, even though Joyce has done dramatically less than Johnny and I to attain the positions we now have.

Joyce is not poor because of one reason - me. His career now is the fictitious position of an unpaid ex-member of the Smiths. He has also pursued all of his claims on Legal Aid.

I don't make this statement in search of sympathy from anyone, but I wish that the people at MorrisseySoLow who support Joyce would at least get their facts right before they say anything. Even with his 10% share, Joyce was wealthy. Now, he is extremely wealthy.

What more does he want?

I have fought the Joyce action as much as I could over the years, but the simple truth is that, under British law, the word of a judge will not be overturned. In the absence of any evidence from the 1980s, the judge in this case relied upon the Partnership Act of 1890 to help Joyce win his claim. Joyce has exploited the judge's final verdict in order to get as much as he can from me, from Johnny Marr, and also from Andy Rourke.

Finally, Joyce does not have the legal right to sell unreleased Smiths material - it belongs to Warner Music. Joyce did not pay for the recording time under which any demo material was recorded. Furthermore, Joyce cannot sell any unreleased work by Johnny Marr or Andy Rourke without, at very least, their permission.

I think its a disgrace that Badly Written Songs will end up getting more time than New Order due to his pointless ramblings and crappy boring acoustic songs (and that bloody flute). Depends on how many bands actually play though. I hope though that they dont go as smaller than Stephen Fretwell (I'm looking at you, John Robb) and that we actually have some more proper, decent bands added. Richard Ashcroft would do well to make an appearance.

You're right, it was shit in '98, the venue is dreadful, its huge and it'll be empty - at £40 plus handling fee I think I may take my chances with a tout (tickets were being sold for a fiver last time they played this void) and then sending the rest via NOOL charity day. Can't see touts investing too much in this gig though after the Brixton/Wireless price crashes this year.

It wouldn't surprise me if this event gets cancelled due to sluggish ticket sales - who'd heat that place in the middle of winter for a couple of thousand people rattling round in it? Hearing about the timing I am a bit worried about how long the Ordah will get. I thought that these days, local licensing/police etc. only allow for gigs to run up to 11-11.30 p.m. before curfew.

Last year, the Mondays though played later but that was on the night the clocks were put back.

I predict that the gig will close with some sort of supergroup singalong event.

a good good night 2 bottles of wine at rinkon before the gig got us ready and i did enjoy all acts fretwell is not for men arena but is a good guy. suprised at bez's group, she was feisty!! so glad we were standing. as soon as warsaw hit i left the family and hit the pit

been puzzling me ALL NIGHT LONG who i met at a certain point in the night.It was indeed MONTY.Glad we met.

Cracking night, not just NO but also seeing the others in the line up. We missed 808 State which was our only downer music-wise.

However, we had our ticket stubs taken off us upon entering the floor area so does anyone have theirs still and not wish to keep it? I'll pay a few bob for it!

I had a brilliant night, but I think it was a little naughty doing all joy division as it was a charity thing and not their audience. I went with a mate who's not a NO fan (well a little), and he didn't seem to have a clue.

Then again, I was made up (in the happy sense, I'd left the eyeliner at home).

we was in the dry Bar before the show,but it was Confused with the 2 Pubs ,we walk away and back and away...

Yep, theres the legend that is Mario. he fell asleep outside the pub before the QEH gig.

Wonder how much was ultimately made for the Christie Hospital??? It looked a pretty decent attendance on the night from where I was standing.
