Howdy,

I've written a book which I'm about to get published (it has very little to do with New Order), however I've used some New Order lyrics as headers for chapters.

Does anyone know how I can go about getting permission from the copyright owners before I go ahead and publish, rather than have to ballache about getting sued for infringement ?

Are you self-publishing? Otherwise, it's the responsibility of your publisher to go and seek out permission to use quotes (and, invariably, pay for the use of said quotes).

But, if it's got f'all to do with the plot or of any real significance to the storyline whatsoever, bar being used in chapter titles, then any publisher with half a braincell will just tell you to rename your chapters ... what's the point in seeking out / paying for permissions to use certain lyrics when they serve no overall purpose?!

Funny you should mention this, as i've just been reading a book that does the same [In Ma Head, Son-The Footballers Mind Revealed by Pat Nevin and George Sik] Title of Chapters include:

True Faith Doubts Even Here Power,Corruption and Lies

You can't copyright a phrase like True Faith though. Or even Doubts Even Here. If yer quoting whole tranches of lyrics without persmission, mind, then you're onto a hiding to nothing!

If it's fiction, you can also claim fair artistic use - i.e. your work of art incorporates and somehow builds on it or comments on it or otherwise has some artistic purpose for using it (think of a pop art painting - Campbells soup couldn't have sued Andy Warhol). It's not really a black and white area, but I think a reasonable person knows what artistic use is (as opposed to trying to steal someone else work under the guide of art).

Yes, generally there is a "fair use" clause which allows people to quote small excerpts of copyrighted works for various reasons. For instance, lyrical or literary quotes used in reviews.

The book itself is about a bloke who gets himself into a heap of sh*te in Thailand, it should be hitting a print on demand website before the year is up.

It's a cross between Trainspotting and The Beach, the opening scene is in a bar on Soi Yamoto, I'm in Thailand for the winter if you're heading over there

My mam and da live in Bangkok. Sukhumvit Soi 12.

I'd live there if i could, but the footy's on at mad hours in the morning. (unless its a 1.45pm kick off)

My dads got the day off today in Bangkok.

he works for Linfox Transport Company. employed by the Aussies.

The King will sort it out though.

No, usually the lyrics are "printed by permission of".. blablabla.

And it's also the place you get licensing for tribute albums if you want ;)

Warner/Chappell is the company just for licensing.

What's been going on for the last year or so has a lot to do with the King and posturing for when the innevitable happens, although I wouldn't say that too loud on the SkyTrain.
