Is there a legal basis for this? Unless his barrister(s) can prove legally that they cannot use the name, they cannot be stopped from using the name New Order. After all, many major festivals and gigs around the world have been booked. It'd be too late to change the posters and say 'the members that were New Order' or some other expression, wouldn't it.

I would love to be able to get on with my life, but after 30 odd years in a band, I have to listen to Radio Two to find out something’s happening with the band?

Hooky left New Order, and not on good terms. In that situation how can you expect to find out what's happening with the band (rest of them) in a different way?

Saddest thing of all for me is that Hooky probably had a valid case back in 2006/7. But the whole thing has been so badly handled, with playground insults and flying off the handle rather than letting lawyers work on developing the case in silent, it is difficult to have much sympathy. It could all have been sorted out under the radar without need to recourse to sound byte.

That said, we now have two bands to watch, both of whom play music we like (else we wouldn't be here in the first place, surely?)

thx for the link - Hooky always comes across great on the radio shows - has a knack for it, for the on air banter and tales -

favorite part of his Hacienda book were his stories -

and, about 55m in, it really sounds like Hooky could be open to a reunite in the future - it is odd how clear and calm he seems to be about the split here - he knows all the back and forth is foolish... so bizarre that they can't all just grow up and shake hands -

Harsh, but then again, you'd think his lawyers would be telling him to STFU. One thing you don't want to do when things go legal is to start a parallel warfare through 1001 news agencies. Hooky deserves ongoing royalties for any future New NO work as the band go on without him and go on I'm sure they they will. Things are spectacularly poisonous now, but best, even ex-best mates can eventually heal wounds (can take years and years), but the scars are going to run very deep and it will be a very formal business arrangement if Barney and Hooky ever appear on the stage again.

I agree. For ages as I couldnt really see why Hooky was getting such grief, I was happy with what both sides were doing. Now I find it impossible to stick up for the Hookster, and Bernard continue to plays it to perfection by saying very little and allowing Hooky to dig even deeper.

It makes me yearn for the happy days of Hacienda-dancefloor-fretboards-gate.

I don't know. She hasn't said anything disrespectful about Hooky in her recent interviews (unless you want to say that disagreeing with what he's doing is 'sniping').

No, he doesn't - HE QUIT THE BAND. He's owed royalties on any recorded work he's previously participated in - at the rate that's been negotiated on signed contracts - but why the hell would they pay him any ongoing royalties otherwise? Just because he was your favorite bass player or had a unique style that once defined their work doesn't mean they owe him anything going forward. Peter Hook was only one fourth (technically now one fifth) of New Order. Why can't people wake up to the fact that he's GONE, and his own horrible behavior has ensured that he'll never be invited back?

No. What little comment she's had is merely noting how childish he's been acting. Meanwhile, he's been insulting to Gillian on a personal level about everything from her musicianship and participation in New Order to her cancer - which is beyond low, in my opinion. This is revisionist history from Hook, nothing more.

While Hooky certainly will get songwriting royalties and performance royalties from the songs he was involved in, he obviously wouldn't get royalties from any new songs that this lineup of NO may write. (That is, if this lineup of NO writes anything new, Hooky has nothing to do with those new songs because he's no longer in the band. )

And this is where much of the problem lies. He won't get anywhere near as much in the way of royalties from NO legacy music, as the publishing contracts were renegotiated, leaving him with less of the publishing money, even on Blue Monday etc not just any later material.

I assume people noticed when songs predominantly written by Hooky stopped appearing in the set? Remember Bernard's quote introducing Temptation at Finsbury Park in 2002?

Personally I want to enjoy the music. I know that the music business involves money, but maybe if he kept his mouth shut to the press about it, that would be better.
