Hargreaves quits over drink-drive incident Markus Mannheim Thursday, 8 June 2006

Territory and Municipal Services Minister John Hargreaves has resigned from cabinet after being caught driving with a blood- alcohol level almost twice the legal limit. He now faces the possibility of a fine of up to $1500 and as long as nine months in jail.

Officers at a random breath-testing station on Tuggeranong Parkway stopped Mr Hargreaves, who was police minister before the April 18 cabinet shuffle, late on Tuesday night.

The Labor frontbencher recorded a blood-alcohol reading of 0.097 and was escorted to the Tuggeranong police station.

Police told Mr Hargreaves later he would be prosecuted by court summons.

The Brindabella MLA, at times visibly stressed, told the Legislation Assembly yesterday morning that he had decided to stand down from the ministry until the legal proceedings likely to follow are resolved.

it has happen previously, but the minister at the time (different government) somehow managed to get off that charge.

.05 is pretty tough. I think it's still .08 here in NY. Maybe they've changed it recently though. They just won't let us have any fun.

Here are the limits per California DMV:

-a motor vehicle with a BAC of .08% or higher.

-a vehicle requiring a commercial driver license with a BAC of .04% or higher.

-a motor vehicle with a BAC of .01% or higher, if the person is under age 21.

-a motor vehicle with any measurable BAC, if the person is under age 18.

these are the limits here:

Zero applies to:

ALL learner drivers. ALL Provisional 1 drivers. ALL Provisional 2 drivers.

0.02 applies to:

Drivers of vehicles of "gross vehicle mass" greater than 13.9 tonnes. Drivers of vehicles carrying dangerous goods. Drivers of public vehicles such as taxi or bus drivers. A BAC of 0.02 can be reached after the consumption of only one standard drink (a middy of beer, a nip of spirits or a small glass of wine). This means that drivers subject to a 0.02 limit must not consume any alcohol before driving.

0.05 applies to:

ALL other licences not subject to a 0.02 or zero limit.
