And what about "retro" bands who haven't recorded any new material for 20+ years but have people in the band as band members; under your rules they CANNOT be band members?

Er... I thought session musicians were people who played on recordings, but weren't band members.

My point is, we can argue about terminology until we are all blue in the face, but Chapman has not yet played any material with New Order that he actually helped write. So maybe we should call him a touring member rather than a studio musician, but he is definitely not of the same stature in the band as Barney, Steve, Gillian, or even Phil. There are no songwriting credits to his name. If he had a falling out with the other members, the band would simply replace him without any concern about legal recourse.

derailing this thread further.

As far as i know from playing in a group myself, tom chapman is a member of new order which means he is entitled to perfomance royalties from any gigs aired on tv or offical internet sites and on the live troxy cd he will be entitled to royalties from that as well.

New order could replace him but they would still have to give him his share of the performance royalties so its not as simple as replacing the hired hand if the band ever considered him to be that in the first place which i doubt.

Well, I read that article. Nasty bit of work for a newspaper article. Felt like an angry blog post in first draft to me.

Good to hear that the shows are being rescheduled. I had a feeling that something would get cancelled sooner or later due to all the surrounding dramas. Look forward to seeing you when you make it.
